Marine Scotland (SG 01/04/09)
A new marine management body which is set to play a vital role in managing Scotland's seas is
officially up and running from 1
April 2009. Marine Scotland has direct
responsibility for marine science, planning, policy development, management
and compliance monitoring measures. The current functions of Fisheries
Research Services (FRS), the Scottish
Fisheries Protection Agency (SFPA) and the Scottish Government's Marine
Directorate are brought together under the new organisation.

Architecture and Design Scotland (A+DS) has led a
meeting of Scottish Agencies to examine how to deliver successful outcomes
from planning reform. Working with key agencies such as Transport Scotland, SEPA, SNH, Scottish Water
and Historic Scotland; A+DS has been considering how spatial form can
assist in delivering sustainable economic growth.

1/2004, The Town and Country Planning (Fees for Applications and Deemed
Applications) (Scotland) Regulations
2004, was published to accompany the regulations. A further circular,
2/2007 The Town and Country Planning (Fees for Applications and Deemed
Applications) (Scotland) Amendment
Regulations 2007, was published to accompany amendments made to the fees
schedule of the regulations. Both circulars are extant.
Both circulars are available in the Scottish Parliament Information Centre
(Bib. numbers 35105 and 42672 respectively).

complies with section 17 of the Environmental Assessment (Scotland) Act 2005 with

will be for those bodies responsible for preparing the plans or programmes
which sit below the National Performance Framework and contribute to
progress towards the Purpose and National Outcomes which are subject to the
Environmental Assessment (Scotland) Act 2005, to ensure that they comply
with the statutory requirements of section 17 of the act.

to assist local authorities and community planning partnerships to
undertake the environmental assessment of single outcome agreements in

(30/03/09): There are no
plans to specifically assist local authorities and community planning
partnerships to undertake the environmental assessment of their single
outcome agreements. However, a Strategic Environmental Assessment (SEA)
Tool-kit, which includes SEA guidance and templates for each stage of the
assessment process, is available on-line and is designed to assist
responsible authorities within Scotland to undertake

not required to establish Marine Scotland. The Marine Bill will create new
functions for Scottish ministers, which Marine Scotland will deliver on
their behalf.

its reasons are for establishing Marine Scotland before the passage of the

A Answered by Richard Lochhead
(23/03/09): There is wide
support for the establishment of such a body and for the improved marine
management arrangements it will deliver. Awaiting the passage of the Marine
Bill would have meant substantive delay in establishing new delivery
arrangements. Establishing Marine Scotland now means it can begin to
integrate existing functions and resources and prepare for new functions
once the bill is enacted. It also has the benefit of ending uncertainty for
the staff involved and others.

Sarah Boyack: To ask the Scottish Executive which
submissions to the Sustainable Seas For All consultation have been amended
in writing since the consultation closed and whether it will publish each

(23/03/09): One response
from a local authority was amended in writing following the closure of the
consultation. This accommodated amendments made by the Council's Planning,
Housing and Environment Committee which convened later than the closure
date. The amended response was published with all non-confidential
responses on the 23 November 2008.

is committed to this objective but a decision on removing the need for

of the study, which will look at all the relevant issues.

Planning Policy (SPP) 6, Renewable
Energy (March 2007) is a non-statutory document. It is for planning
authorities to apply the policy as they deem appropriate.The
Scottish Government has put in place a number of measures to assist
planning authorities with this including: providing consultancy support and
advice to local authorities on the preparation of Supplementary Planning
Guidance for windfarms; issuing PAN 45 Annex 2,
Spatial Frameworks and Supplementary Planning Guidance for Windfarms; issuing PAN 84, Reducing Carbon Emissions in
New Development.

(20/03/09): Research
published in early 2007 recommended that permitted development rights
distinguish between domestic and non-domestic buildings. We have given
priority to domestic buildings. The research recommended that the same
rights apply to all non-domestic buildings. However, non-domestic buildings
vary enormously in their scale, location and type of activity. We intend to
progress work on non-domestic microgeneration
when matters are resolved for domestic.
