Recent parliamentary answers

Q S3W-22105 Peter Peacock: To ask the Scottish Executive what guidance it has issued to local authorities on issues associated with planning fees. (SP 09/03/09)
A Answered by John Swinney (
30/03/09): Circular 1/2004, The Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Regulations 2004, was published to accompany the regulations. A further circular, 2/2007 The Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Amendment Regulations 2007, was published to accompany amendments made to the fees schedule of the regulations. Both circulars are extant.
Both circulars are available in the Scottish Parliament Information Centre (Bib. numbers 35105 and 42672 respectively).

Q S3W-22109 Peter Peacock: To ask the Scottish Executive how it plans to ensure that it complies with section 17 of the Environmental Assessment (Scotland) Act 2005 with respect to the National Performance Framework. (SP 19/03/09)
A Answered by John Swinney (31/03/09): It will be for those bodies responsible for preparing the plans or programmes which sit below the National Performance Framework and contribute to progress towards the Purpose and National Outcomes which are subject to the Environmental Assessment (Scotland) Act 2005, to ensure that they comply with the statutory requirements of section 17 of the act.

Q S3W-22110 Peter Peacock: To ask the Scottish Executive what action it plans to take to assist local authorities and community planning partnerships to undertake the environmental assessment of single outcome agreements in accordance with the Environmental Assessment (Scotland) Act 2005. (SP 19/03/09)
A Answered by John Swinney (
30/03/09): There are no plans to specifically assist local authorities and community planning partnerships to undertake the environmental assessment of their single outcome agreements. However, a Strategic Environmental Assessment (SEA) Tool-kit, which includes SEA guidance and templates for each stage of the assessment process, is available on-line and is designed to assist responsible authorities within Scotland to undertake their SEA commitments. The tool-kit can be accessed at http://www.scotland.gov.uk/Topics/Environment/14587.

Q S3W-21887 Sarah Boyack: To ask the Scottish Executive what its reasons are for not using the Marine Bill to establish Marine Scotland. (SP 16/03/09)
A Answered by Richard Lochhead (
23/03/09): Legislation is not required to establish Marine Scotland. The Marine Bill will create new functions for Scottish ministers, which Marine Scotland will deliver on their behalf.

Q S3W-21888 Sarah Boyack: To ask the Scottish Executive what its reasons are for establishing Marine Scotland before the passage of the Marine Bill. (SP 16/03/09)
A Answered by Richard Lochhead (
23/03/09): There is wide support for the establishment of such a body and for the improved marine management arrangements it will deliver. Awaiting the passage of the Marine Bill would have meant substantive delay in establishing new delivery arrangements. Establishing Marine Scotland now means it can begin to integrate existing functions and resources and prepare for new functions once the bill is enacted. It also has the benefit of ending uncertainty for the staff involved and others.

Q S3W-21902 Sarah Boyack: To ask the Scottish Executive which submissions to the Sustainable Seas For All consultation have been amended in writing since the consultation closed and whether it will publish each of them in full. (SP 16/03/09)
A Answered by Richard Lochhead (
23/03/09): One response from a local authority was amended in writing following the closure of the consultation. This accommodated amendments made by the Council's Planning, Housing and Environment Committee which convened later than the closure date. The amended response was published with all non-confidential responses on the 23 November 2008.

Q S3W-21775 Sarah Boyack: To ask the Scottish Executive whether it is still committed to removing the need for planning permission for micro wind turbines. (SP 13/03/09)
A Answered by John Swinney (
20/03/09): The government is committed to this objective but a decision on removing the need for planning permission for micro-turbines will depend on the recommendations of the study, which will look at all the relevant issues.

Q S3W-21779 Sarah Boyack: To ask the Scottish Executive what measures it intends to put in place to ensure that local authorities fully implement Scottish Planning Policy SPP 6: Renewable Energy. (SP 13/03/09)
A Answered by John Swinney (
20/03/09): Scottish Planning Policy (SPP) 6, Renewable Energy (March 2007) is a non-statutory document. It is for planning authorities to apply the policy as they deem appropriate. The Scottish Government has put in place a number of measures to assist planning authorities with this including: providing consultancy support and advice to local authorities on the preparation of Supplementary Planning Guidance for windfarms; issuing PAN 45 Annex 2, Spatial Frameworks and Supplementary Planning Guidance for Windfarms; issuing PAN 84, Reducing Carbon Emissions in New Development.

Q S3W-21780 Sarah Boyack: To ask the Scottish Executive what measures it is taking to address the level of skill in carbon assessment linked to the implementation of planning regulations. (SP 13/03/09)
A Answered by John Swinney (
20/03/09): Officials are in discussion with the Improvement Service about a range of training and development matters associated with planning modernisation.

Q S3W-21781 Sarah Boyack: To ask the Scottish Executive whether it is committed to introducing permitted development rights for the installation of renewable technology S3W-21784 Sarah Boyack: To ask the Scottish Executive whether it intends to develop a strategy to improve the energy efficiency of existing building stock for non-domestic buildings. (SP 13/03/09)
A Answered by John Swinney (
20/03/09): Research published in early 2007 recommended that permitted development rights distinguish between domestic and non-domestic buildings. We have given priority to domestic buildings. The research recommended that the same rights apply to all non-domestic buildings. However, non-domestic buildings vary enormously in their scale, location and type of activity. We intend to progress work on non-domestic microgeneration when matters are resolved for domestic.

Q  S3W-20943 - Hugh Henry : To ask the Scottish Executive what the criteria will be for applications for funding from the £60 million Town Centre Regeneration Fund. (SP 13/02/09)
A Answered by Alex Neil (
10/03/09): I refer the member to answer to question S3W-20618 on 26 February 2009. All answers to written parliamentary questions are available on the Parliament''s website, the search facility for which can be found at http://www.scottish.parliament.uk/Apps2/Business/PQA/Default.aspx
